COLLECTION NOTICE

This collection notice outlines how we collect and handle your personal information in compliance with the Privacy Act 1988 (Cth). In this collection notice “we”, “our” and “us” refers to Fresh Networking Pty Ltd ACN 617 779 656 and their associated entities and authorised representatives. 1. Why we collect your personal information and how we will use it

We collect and use your personal information for the purpose of organising, hosting, facilitating and promoting Fresh Networking events (including all social gatherings, classes, seminars, webinars, mentoring, and all other educational and informational sessions organised, promoted or facilitated by Fresh (collectively referred to as our Events). This also includes sending you information about our Events and services, offers and promotions and communicating changes to our services or terms and conditions, as well as receiving, considering and approving all membership applications to become a member of the Fresh Networking community.

2. Circumstances where we collect your personal information and you may not be aware

We use “Cookies” to monitor your use of our websites. These are small files that are transferred to your computer’s hard drive through your web browser and enable our sites to recognise your browser and remember certain information. If you don’t want information collected through cookies you can configure your computer so that it disables or rejects them.
We and our analytics provider collect and store analytics information when you use our Websites to help us improve our products and services.
Analytics information also consists of data we collect as a result of running queries against Content across our user base for the purposes of generating Usage Data. “Usage Data” is aggregated data about a group or category of services, features or users that does not contain Personal Information.

3. Collection of your personal information from third party sources
We may collect your personal information from third party sources, which may consist of Fresh community members and/or attendees of our Events. Other third party sources from which we may collect your personal information includes bookings platforms used to promote and facilitate our events.
We do not warrant that these third party sources have the same level of privacy protection as us, and you should review their privacy policies to ensure compliance with the Privacy Act 1988 (Cth).

4. Sensitive Information
We do not currently collect sensitive information and will not do so in the future without first obtaining your written consent.

5. Direct Marketing
We use your personal information to send you marketing materials and information about our Events, products and services, membership options, offers and promotions. We will not use any sensitive information we collect from you for direct marketing without your prior consent.
If you change your mind in the future, you may withdraw your consent to receive direct marketing by clicking on the “opt out” or “unsubscribe” link on emails, or by contacting us at getfresh@freshnetworking.com.au.

6. Consequences of you not providing your personal information
We will not be able to provide you with our full range of products and services. In particular, we will not be able to process or accept a booking for our Events or offer you membership of the Fresh community without your personal information. As a business networking community, the sharing of who you are, what you do and how to get in touch with you is a fundamental aspect of our business and community.

7. Who we are likely to disclose your personal information to
(a) Members and guests: as an operator of a business networking community, we need to share your Personal Information with our members and other guests who attend our Events and use our services, who may be third parties. The sharing of such information is an essential part of business networking, and the sharing of Personal Information in this manner is a Primary Purpose for which your Personal Information has been collected.
(b) System Administration: you should be aware that our systems administrator may be able to access information about you and your account.
(c) Service Providers: we work with third party service providers to provide and deliver our services, process payments, perform analysis and other services for us. These third parties may have access to or process your Information as part of providing those services for us.
(d) Laws: we may disclose your Information (including your Personal Information) to a third party if:
(i) we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process or governmental request;
(ii) to enforce our agreements, policies and terms of service;
(iii) to protect the security or integrity of Fresh’s products and services;
(iv) to protect Fresh, our customers or the public from harm or illegal activities; or
(v) to respond to an emergency which we believe in the good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person.
(e) Business Transfers: we may share or transfer your information (including your Personal Information) in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
(f) Anonymised Data: we may also share aggregated or anonymized information that does not directly identify you with the third parties described above.
(g) Marketing: we may share your Personal Information with our marketing services providers so as to market our products and services to you (including direct marketing).
(h) With Your Consent: we will share your personal information with third parties when we have your consent to do so.

8. Accessing, updating or make a complaint about our handling of your personal information
You may access, update or make a complaint about our handling of your personal information by contacting us at getfresh@freshnetworking.com.au. Our Privacy Policy also contains information on how you can access your information, request changes and make a complaint if you have a concern relating to our handling of your personal information or any breaches of the Australian Privacy Policies. 9. Disclosure to overseas entities
(a) We disclose your personal information to Microsoft Corporation trading as Microsoft. Microsoft is located in the United States of America and has subsidiaries located throughout the world. Personal data collected by Microsoft may be stored and processed in Australia, in the United States, and in any other country where Microsoft or its affiliates, subsidiaries, or service providers operate. Microsoft abides by the Privacy Act 1988 (Cth) and APPs.
(b) We disclose your personal information to Google LLC trading as Google. Google is located in the United States of America and has subsidiaries located throughout the world. Personal data collected by Google may be stored and processed in Australia, in the United States, and in any other country where Google or its affiliates, subsidiaries, or service providers operate. Google abides by the Privacy Act 1988 (Cth) and APPs.
